Dunolly Cottage is offered for let by Ryton Aberfeldy Limited ("RAL"). In seeking to make a booking you will be entering into a contract negotiation with RAL and if a booking is confirmed you will have entered into a contract with RAL. RAL may be represented by the proprietors of the business or their formally designated agents. References to RAL in these terms and conditions should be taken to mean the company or, when appropriate, their designated agents. Ryton Aberfeldy Limited is registered in Scotland, registration number 527459, and the registered office address is Taybank, Taybridge Drive, Aberfeldy, PH15 2BP. Main telephone contact number is 01887 820388. RAL is not a VAT registered entity, so no VAT will be added to the prices you agree to pay when booking direct, nor are the prices we quote inclusive of VAT. RAL will respond to queries, complaints and problems which arise in the course of the booking process, during or after any Holiday Period and always use its best efforts and goodwill to resolve them.
RAL's Liability
RAL does not exclude or limit in any way their liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by their negligence or the negligence of their employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the Rental Services including the right to receive the Rental Services supplied with reasonable skill and care.
To the fullest extent permissible under applicable law, we disclaim any and all other promises, warranties, conditions, or representations relating to the Rental Services, whether express, implied, oral or written. In particular, we do not make any promises about:
- the availability of the Booking Service or this Site or that they will be provided uninterrupted or error or virus-free;
- errors or inaccuracies in any documentation supplied, including any documentation that appears on the Site; or
- the quality, suitability or performance of the Rental Services, or the Property.
RAL shall not be liable to you for any losses in the event the cancellation of bookings in full or in part or due to circumstances or events beyond their control.
RAL do not authorise anyone to make any promises on their behalf.
RAL will not be responsible or liable for any losses related to any business of yours including but not limited to lost data, profits, revenue, business, opportunity, goodwill, reputation or business interruption as a result of your use of this site.
Notwithstanding the above, RAL will maintain, at the RAL's expense and with a reputable insurance company, policies to meet the RAL's liabilities under the Rental Contract with you; RAL will comply with all applicable laws and regulations, in particular, relating to fire, health, safety and data protection; and RAL will use best endeavours to ensure that Dunolly Cottage is properly maintained, clean, tidy and in good repair at the start of the Holiday Period. RAL does accept Dogs, if properly notified as part of the booking process. If You or any Guest has a pet allergy, we cannot guarantee that all traces of previous occupants will have been removed, therefore we cannot accept any responsibility for any subsequent health reaction.
Booking Confirmation and Closing of the Contract
The following steps have to take place before a contract is made between yourselves and RAL for the provision of the Rental Services under a Rental Contract by means of a direct booking:
You submit your Booking form on the Site by submitting your Booking Details and your payment details for processing by pressing 'Pay Now'. Before submitting your Booking on the Site, the Booking process will give you the opportunity to review the Booking, these Booking Conditions and the Booking Details for Dunolly Cottage and, if you require, make amendments to your Booking. You will receive an on-screen acknowledgement of your Booking and a receipt for your payment by email at the address provided.
For telephone bookings RAL or its designated agent will read you details of your Booking and Booking Conditions for your confirmation. You may make any required amendments at this point. Payment details will then be requested and processed. For telephone bookings we will verbally confirm your booking and will send you a receipt for your payment by email at the address provided.
After you receive your Booking Confirmation you will not have a legal right to cancel the Rental Contract as the Rental Services provided under it are accommodation and leisure services for which the contract provides a specific period of performance. However, you may immediately end a Rental Contract if RAL have told you about an error in the charges or Booking Details or a significant error in the description of the Rental Services relating to your Booking and you notify RAL that you do not wish to proceed.
Although bookings via an agent will result in a contract between You and RAL, please refer to their Terms and Conditions of business to determine at what point that contract is made.
Payments
Payment method will be agreed at the time of booking and in part depends on whether this is a direct booking or via an agent.
Governing Law and Jurisdiction
Any dispute, claim or other matter which may arise in relation to your booking will be governed by English law and you agree that any dispute will be dealt with exclusively by the courts of England and Wales.
